1) Promoter
1.1 The promoters of this promotion are:
Clean Collective Limited in New Zealand and Clean Collective Australia Pty Ltd in Australia. Contact: hello@cleancollective.co
1.2 In these Terms & Conditions, “Promoter”, “we”, “us” or “our” means the relevant Promoter depending on the winner’s country of residence (or both where applicable). “You” or “entrant” means an eligible participant.
2) Promotion period
2.1 The promotion opens 8am NZDT on 22 December 2025 and closes 11:59pm NZDT on 18 January 2026 (“Promotion Period”).
2.2 Entries posted outside the Promotion Period will not be valid.
3) Eligibility
3.1 Entry is open to New Zealand and Australian residents aged 18 years or over.
3.2 Employees, directors, officers, and immediate families of the Promoter and its agencies/contractors associated with the promotion are ineligible.
3.3 The promotion is void where prohibited by law.
4) How to enter
4.1 During the Promotion Period, to receive one (1) entry you must, from an Instagram account you control:
a) Follow @cleancollectiveofficial; and
b) Post either to your Instagram Feed or Stories a photo featuring Clean Collective alcohol premixes or energy drinks; and
c) Tag @cleancollectiveofficial in the post/story.
4.2 No purchase is required to enter. Entry is free.
4.3 Your Instagram account must be public at the time you post your entry (and remain public until at least the draw time) so we can view the tagged content.
4.4 We are not responsible for entries that are not visible to us due to privacy settings, tagging errors, content removal/expiry (including Stories), platform outages, or any other reason outside our control.
4.5 Entry limit: Multiple entries are permitted, however each entry must be a separate, unique post/story. We may, in our reasonable discretion, disqualify entries/accounts that appear to be spam, automated, or intended to unfairly manipulate the promotion.
5) Entry content rules (“Keep it clean and kind”)
5.1 Your entry must not include (as determined by us in our reasonable discretion):
a) nudity, sexually explicit content, violence, hate speech, harassment, threats, bullying, or discrimination;
b) illegal, unsafe, or dangerous behaviour;
c) content that is defamatory, deceptive, misleading, or likely to cause offence;
d) depictions of irresponsible alcohol consumption, intoxication, binge drinking, drinking games, rapid consumption, or any behaviour that encourages excessive consumption;
e) anyone who appears to be under 25 drinking alcohol, and any minors in connection with alcohol (we recommend avoiding minors entirely);
f) third-party branding/logos in a way that may infringe rights or imply endorsement (other than incidental background).
5.2 We may reject or remove (or require you to remove) any entry content that does not comply with these Terms.
6) Your permissions, consents, and warranties (VERY IMPORTANT)
By entering, you warrant and agree that:
6.1 Ownership / rights to post: You either own the photo/video you post, or you have obtained express permission from the copyright owner/creator/photographer to post it and to grant the licence in clause 7.
6.2 Permission from people featured: You have obtained express permission from every identifiable person appearing in your entry content for:
a) you to post it publicly on Instagram; and
b) the Promoter to use it as described in clause 7.
If any person featured is under 18, you warrant you have the consent of their parent or legal guardian (and we may request evidence).
6.3 No infringement: Your entry does not infringe any third-party rights (including copyright, trade marks, moral rights, publicity/personality rights, or privacy rights).
6.4 Not offensive / not unlawful: Your entry is not offensive, defamatory, discriminatory, obscene, or otherwise unlawful, and does not violate Instagram/Meta rules or any applicable advertising standards.
6.5 Responsibility for posting: You acknowledge you are solely responsible for what you post, including any consequences, claims, complaints, investigations, or disputes arising from your content.
7) Licence to use your entry content
7.1 By entering, you grant the Promoter a worldwide, royalty-free, irrevocable, perpetual, non-exclusive licence to use, reproduce, publish, share, repost, edit, adapt, and display your entry content (in whole or part) for promotional and marketing purposes in any media, including (without limitation) on the Promoter’s social channels, websites, email, digital advertising, and in-store materials.
7.2 You consent to the Promoter editing your entry content for formatting and platform requirements (e.g., cropping, adding text overlays, resizing).
7.3 You agree the Promoter may attribute your Instagram handle when reposting, but is not obliged to do so.
8) Not responsible for anything arising from your post/tag (release + indemnity)
8.1 To the maximum extent permitted by law, the Promoter is not responsible for (and you release the Promoter from) any loss, damage, liability, injury, claim, cost, or expense arising from or connected with:
a) your creation, posting, publication, tagging, or sharing of the entry content;
b) anyone’s reliance on, reaction to, or republication of your entry content;
c) any allegation that your entry content infringes rights, invades privacy, is defamatory, is misleading, or is offensive;
d) your breach of Instagram/Meta rules or any applicable laws/standards;
e) any misuse of your entry content by third parties (including reposting by other users).
8.2 You indemnify (and will keep indemnified) the Promoter against any and all claims, losses, damages, liabilities, costs (including legal costs on a solicitor-client basis), and expenses suffered or incurred by the Promoter arising out of or connected with:
a) your entry content;
b) your breach of these Terms; or
c) any claim by a third party relating to your entry content or your act of posting/tagging.
9) Prize details
9.1 There is one (1) prize to be won. The prize consists of:
Petrol voucher valued at $250
Restaurant voucher valued at $500
Supermarket voucher valued at $250
9.2 Total prize pool value is up to $1000 in the winner’s local currency (NZD for NZ winners / AUD for AU winners), unless otherwise stated by the Promoter.
9.3 No alcohol is included in the prize.
10) Draw and winner notification
10.1 The winner will be selected by random draw from all valid entries received during the Promotion Period.
10.2 The draw will take place on 19 January 2026 (NZDT).
10.3 The winner will be notified via Instagram direct message from @cleancollectiveofficial on 19 January 2026.
10.4 If the winner cannot be contacted, does not respond, or does not provide required information within 72 hours of being contacted (or such longer time as we may allow), they may forfeit the prize and a redraw may occur.
11) Verification
11.1 The Promoter may request proof of eligibility (including age and residency) and may request evidence of permissions/consents under clause 6.
11.2 If requested information is not provided to the Promoter’s satisfaction within a reasonable timeframe, the entry may be deemed invalid and the prize forfeited.
12) Prize conditions
12.1 Vouchers are subject to the issuing provider’s standard terms (including any expiry dates and usage restrictions).
12.2 The prize is not transferable, exchangeable, or redeemable for cash (unless required by law).
12.3 The Promoter is not responsible for lost, stolen, damaged, or expired vouchers.
12.4 If any part of the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize (or part of a prize) of equal or greater value.
13) General conditions
13.1 The Promoter may disqualify any entrant who tampers with the entry process, submits an entry not in accordance with these Terms, or acts in a fraudulent, misleading, or disruptive manner.
13.2 If this promotion is interfered with or cannot be conducted as reasonably planned due to technical failures, unauthorised intervention, fraud, pandemic/public health restrictions, or any other event beyond the Promoter’s reasonable control, the Promoter may (to the extent permitted by law) modify, suspend, terminate, or cancel the promotion.
13.3 The Promoter’s decisions are final and no correspondence will be entered into.
14) Privacy
14.1 The Promoter collects personal information (such as your Instagram handle, and winner delivery details) to administer the promotion, verify eligibility, contact the winner, and deliver the prize.
14.2 Personal information will be handled in accordance with the Promoter’s applicable privacy policy (NZ and/or AU, as relevant).
15) Liability limitations (important)
15.1 Nothing in these Terms limits any consumer guarantees or rights that cannot legally be excluded.
15.2 Subject to clause 15.1, to the maximum extent permitted by law, the Promoter excludes all liability for any loss or damage suffered in connection with the promotion or prize (including indirect or consequential loss), including but not limited to technical issues, platform actions, or third-party conduct.
16) Instagram / Meta disclaimer
16.1 This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta.
16.2 You release Instagram/Meta from any responsibility for this promotion and acknowledge that you are providing information to the Promoter and not to Instagram/Meta.
17) Governing law
17.1 These Terms are governed by the laws applicable in the entrant’s country of residence (New Zealand or Australia), and entrants submit to the non-exclusive jurisdiction of the courts in that place.

1. Promoter
1.1 The promoter is Clean Collective Limited, New Zealand (“Promoter”, “Clean Collective”).

2. Eligibility
2.1 Entry is open to New Zealand residents aged 18 years and over (“Eligible Entrants”).
2.2 Employees, directors and contractors of the Promoter, FreshChoice supermarkets, and their related companies, agencies and immediate families (spouse, de facto partner, parent, child and sibling) are not eligible to enter.
2.3 The Promotion is only open to individuals. Entries from businesses, groups or organisations will not be accepted.
3. Promotion Period
3.1 The Promotion commences at 12:00am NZT on 5 December 2025 and closes at 11:59pm NZT on 11 January 2026 (“Promotion Period”).
3.2 Entries received outside the Promotion Period will not be accepted.
4. Participating Stores & Qualifying Products
4.1 The Promotion applies to purchases of single 330ml cans of Clean Collective Energy (“Qualifying Products”) from participating FreshChoice supermarkets in New Zealand during the Promotion Period.
4.2 Participating stores are any FreshChoice supermarket in New Zealand that stocks Clean Collective Energy. Product availability may vary by store and while stocks last.
4.3 Multi-pack purchases of Clean Collective Energy are eligible, but only to the extent they contain 330ml cans of Clean Collective Energy; entries will be calculated based on the number of 330ml cans purchased, in accordance with clause 6.
5. How to Enter
5.1 To enter the Promotion, an Eligible Entrant must, during the Promotion Period:
(a) Purchase at least one (1) Qualifying Product in a single transaction from a participating FreshChoice supermarket in New Zealand; and
(b) Visit cleancollective.co.nz/pages/freshchoice (“Promotion Website”); and
(c) Complete the online entry form in full, including their full name, email address, and any other required details; and
(d) Upload a clear image or PDF of the itemised purchase receipt for the Qualifying Product(s) (“Receipt”).
5.2 Internet access and a compatible device are required to enter. Standard data charges may apply and are the responsibility of the entrant.
5.3 By submitting an entry, entrants confirm that all information provided is true, correct and complete.
5.4 By submitting an entry, entrants acknowledge and agree that they will be subscribed to the Clean Collective e-newsletter, as further described in clause 12.3, and that they may unsubscribe at any time.
6. Number of Entries
6.1 One (1) 330ml can of Clean Collective Energy purchased on a single Receipt equals one (1) entry into the Promotion.
6.2 If an Eligible Entrant purchases multiple Qualifying Products (for example, 3 x 330ml cans of Clean Collective Energy, whether individually or as part of a multi-pack) on one Receipt, they will receive the corresponding number of entries (in this example, 3 entries), provided the Receipt is submitted in accordance with these Terms and Conditions.
6.3 Multiple entries are permitted, however:
(a) Each entry must be associated with a separate eligible purchase of Qualifying Product(s) during the Promotion Period; and
(b) Each Receipt can only be used once. A single Receipt cannot be uploaded and used as the basis for entries multiple times.
6.4 The Promoter may, at its discretion, require entrants to provide original Receipts (not copies) as proof of purchase for verification. Failure to provide a valid original Receipt upon request may result in disqualification.
7. Prize
7.1 There is one (1) prize to be won.
7.2 The prize is a “year’s supply of Clean Collective Energy” (“Prize”). For the purposes of this Promotion, a “year’s supply” is defined as:
365 x 330ml cans of Clean Collective Energy (any flavour, as determined by the Promoter in its sole discretion),
supplied either as physical product and/or in the form of product vouchers, as determined by the Promoter.
7.3 The total recommended retail value (RRP) of the Prize is up to NZD $1204.50 (including GST). The actual value may vary depending on RRP at the time of fulfilment.
7.4 The Prize is not transferable, exchangeable or redeemable for cash, except where required by law.
7.5 The Promoter reserves the right to substitute the Prize (or any part of it) with a prize of equal or greater value if the Prize is unavailable for any reason.
7.6 The Prize will be delivered to the winner’s nominated New Zealand residential address or provided via product vouchers sent to the winner’s nominated email or physical address (as determined by the Promoter).
8. Prize Draw & Winner Notification
8.1 The winner will be determined by a random draw from all valid entries received during the Promotion Period.
8.2 The draw will take place at the offices of the Promoter (or its appointed agent) within ten (10) working days of the end of the Promotion Period.
8.3 The Promoter will make reasonable efforts to contact the winner using the contact details provided at the time of entry (including by email and/or phone).
8.4 If the winner cannot be contacted, does not respond within five (5) working days of the first contact attempt, is ineligible, or fails to comply with these Terms and Conditions, the Promoter may, in its sole discretion, declare that entry invalid and conduct a further random draw to select an alternative winner.
8.5 The Promoter’s decision is final and no correspondence will be entered into.
9. Verification & Disqualification
9.1 The Promoter reserves the right to verify the validity of entries and entrants (including age, residency and proof of purchase) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions, tampers with the entry process or engages in any fraudulent, misleading or inappropriate conduct.
9.2 Incomplete, indecipherable, or illegible entries, or entries that do not include a valid Receipt clearly showing the date of purchase during the Promotion Period, store name and Qualifying Products purchased, may be deemed invalid.
9.3 Receipts that are altered, duplicated, fake, or that appear to have been tampered with or re-used may result in disqualification of the corresponding entry or entries.
9.4 The Promoter may withhold awarding the Prize until it has received satisfactory verification, as determined in the Promoter’s sole discretion.
10. Cancellation, Suspension or Variation
10.1 The Promoter reserves the right to cancel, suspend, terminate or vary the Promotion (including these Terms and Conditions and the Prize) at any time, for any reason, subject to applicable laws.
10.2 If the Promotion is varied, suspended or cancelled, the Promoter will use reasonable endeavours to provide notice, including by updating the Promotion Website and/or promotional materials, where reasonably practicable.
11. General
11.1 Entry into the Promotion is deemed acceptance of these Terms and Conditions.
11.2 Entrants are responsible for ensuring their contact details are correct and up to date. The Promoter is not responsible for any inability to contact an entrant due to incorrect or incomplete contact details being provided.
11.3 Any costs associated with entering the Promotion (including internet and data charges) are the responsibility of the entrant.
11.4 The Promoter may, at its absolute discretion, request that the winner participates in reasonable promotional and marketing activities (such as photography, social media content or testimonials) without further compensation, and consents to the Promoter using their name, likeness and image for such purposes. The winner may decline to participate in such activities.
12. Privacy & E-Newsletter Subscription
12.1 The Promoter collects personal information from entrants in order to conduct the Promotion, verify entries and award the Prize, and may, for these purposes, disclose such information to third parties (including agents, contractors, service providers, prize suppliers and, where required, to New Zealand regulatory authorities).
12.2 If an entrant does not provide the requested personal information, they may not be able to participate in the Promotion or claim the Prize.
12.3 By entering the Promotion, entrants acknowledge and agree that:
(a) they will be subscribed to the Clean Collective e-newsletter and added to the Clean Collective marketing database; and
(b) the Promoter may use their personal information to send them marketing and promotional communications (including by email) about Clean Collective products, services, promotions and offers.
12.4 Entrants may opt out of receiving marketing communications at any time by using the unsubscribe link in any email received or by contacting the Promoter using the details set out on the Clean Collective website.
12.5 Entrants may access and request correction of their personal information by contacting the Promoter at the details provided on the Clean Collective website.
12.6 All personal information will be collected, used, stored and disclosed in accordance with the Promoter’s Privacy Policy, available at cleancollective.co.nz.
13. Responsibility and Liability
13.1 To the maximum extent permitted by law, the Promoter, FreshChoice, and their related companies, directors, officers, employees and agents (together, “Released Parties”) are not responsible for and accept no liability for:
(a) any late, lost, misdirected, incomplete, illegible, corrupted or incorrectly submitted entries;
(b) any technical malfunctions, delays or failures (including but not limited to internet, website or platform issues) that affect the Promotion or any entry;
(c) any failure of a Receipt to be safely or timely received by the Promoter; or
(d) any loss, damage, personal injury or death, whether direct, indirect, special or consequential, in any way arising out of or in connection with the Promotion or the Prize, except to the extent caused by the negligence of a Released Party or otherwise required by law.
13.2 Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights that entrants may have under the New Zealand Consumer Guarantees Act 1993 or any other applicable consumer law that cannot lawfully be excluded.
13.3 By entering the Promotion, entrants agree to release, indemnify and hold harmless the Released Parties from any claim, action, damage, loss, liability, cost or expense incurred in connection with their participation in the Promotion or acceptance and use of the Prize, except to the extent caused by the negligence of a Released Party or otherwise required by law.
14. Third Parties
14.1 FreshChoice supermarkets participate in the Promotion as sales outlets for the Qualifying Products only and are not responsible for the conduct or administration of the Promotion.
14.2 Any questions or disputes regarding the Promotion should be directed to the Promoter, not to FreshChoice.
15. Governing Law
15.1 The Promotion and these Terms and Conditions are governed by the laws of New Zealand.
15.2 Entrants submit to the non-exclusive jurisdiction of the courts of New Zealand in relation to any dispute arising out of or in connection with the Promotion or these Terms and Conditions.
